G'morning everyone!

Now that we've all had at least a month to finalize sales, I think it time to collect the funds & send them on to SGK :D

If everyone would like to 'chime in' & (PRIVATELY) let me know their totals, we can wrap this project up! Sure feels good, doesn't it?

OK everybody now IT'S ABOUT TIME. I FINALLY received my CALENDARS TODAY and I've sold 15 already to the people who were waiting and they just love them. Makes me happy. I only have 15 more to sell and then I'll be after more from you Erica. As I said I'll do my best to sell as many as possible so you can get your investment back.

I understand that the SGK has procedures in place. But, in one sense, it really irks me that we can't even say their name on the website.

Sorry, but we weren't "partnering" with them. We made a calendar. We were going to give the profits to them. I can't see that they had anything at all to do with it. If they were "partnering" with us, they could have helped us get word out, etc.

My opinion is to take their name off the website (done), and just say, we will be giving the proceeds to an organization that is in the fight to eradicate cancers that effect women, or some such thing.

It just gets my panties in a wad that people try to help, and in a way give free advertising to an organization, and they still get all legal-esy.

Cool I can't wait to get them. I've called all the people to let them know that they are almost here and they said that they would be happy to get them so I have my sales back. Thank the good lord for that.

yep, they were marked as a gift. Thats what I dont understand about Daves... I always mark things to Canada as gifts...

we ship alot to my MIL (almost monthly) so its an automatic thing for me to do.

Well the reciept said 5 days. so we will see.. .

The calendars ae now trapped in coustomes. Daves wait for them to clear was a few days from what I remember so I should get them this week. Did you mark them as a gift??

I can always submit the contract application and go from there. If you guys want. If not we can just take their name off any future press releases...and such...

Agreed.


I agree with you as well and I think that they will be happy to receive the donation in spite of their policies.

We're doing a good thing here. I don't think any of us would use their name to profit for ourselves in any way. In spite of what some people think not everyone in the world is out to rip people off and we just want to do something good because it's the right thing to do.

I say we stay the course and send them in the money as before and see how they respond.

Anybody up for doing this again for next year?? If so we should start looking around soon.

Well, we already removed their name from everything, not much they can do now... the pink ribbon theme is non-exclusive.

We will still donate the monies as promised, we just can't tell people what charity it is going to when we are selling the calendars. Just say it is to help breast cancer research. SGK can just be pleasantly surprised to receive a donation.

Here is the reply from SGK. I figure we have 2 choices, but I will let you guys decide how to proceed.

This is the reply:

Hi Erica:
Yes, in order to use the Komen name and our marks (logo) you must have a contract with Komen. These types of partnerships do require a letter of agreement (contract) and the attached will help you begin the process of looking at a potential partnership with Komen.

There are no set costs or benefits for these partnerships ... all partnerships are negotiated based on the nature, timeframe, etc. of each promotion.

We are firmly committed to serve as good stewards of the money we receive from our donors and the goodwill of our sponsors and partners. In an effort to maintain the high standards expected of us from our constituencies, we have instituted the following process to evaluate new opportunities:

- Please complete the “Proposed Program/Promotion Questionnaire” (see attached form) to help us gain a better understanding of the program you envision. We realize some of your program points may need additional discussion, but this will help us gain a snapshot of your vision so discussions can begin.

- Return the questionnaire to XXXXXX at XXXXX. Once we receive it, a program manager will contact you to discuss the potential partnership.

- When the initial review is complete, the proposal will then be presented to an internal panel for evaluation and recommendation.

This internal review / approval process typically takes 14 days. In the meantime, please remove the Komen name from your website until an agreement is in place.

okay and here are the "rules"

• Along with your sample, please forward a company media kit and any other collateral, brochures, reports, about your organization or the program/promotion that will assist us in evaluating your proposal.
• One of our objectives with all cause-related marketing programs is to ensure that consumers are provided with breast health information and a way to contact Komen for further information. You must agree to publish Komen’s toll-free breast care Helpline, 1-877 GO KOMEN, website www.komen.org, and Komen’s promise on all promotions, events and programs to raise awareness and educate the public about breast health/breast cancer. We suggest you include breast health and breast cancer educational/informational messages on packaging, in promotional, advertising and collateral materials to ensure your program will raise awareness and educate the public about this devastating disease.
• Komen operates under the Better Business Bureau guidelines for charitable giving. These guidelines require clear disclosure to the consumer. In compliance with these guidelines, Komen requires full disclosure regarding the benefit to the organization when funds are raised through a consumer purchase or promotion (e.g. $1 from the sale of each item) on all packaging, advertising and promotional materials in clear and unambiguous terms. Your company/organization must be able to comply with this requirement.
• Your organization may also be required to register in certain states as a “commercial co-venturer.” In its simplest terms, a commercial co-venture is a relationship where an organization promotes a product or service and represents to the public that a portion of the proceeds will benefit a cause. If the product or service is being promoted in a state that requires commercial co-venturer registration, the organization conducting the program/promotion must file certain documents with that state’s Attorney General’s office (or other state-designated entity). The specific documents that must be filed will vary from state to state, but will generally include a registration statement and a copy of the contract. Although Komen cannot give legal advice to organizations that conduct programs/promotions with us, we do advise them to seek legal counsel to ensure that they comply with these registration requirements.
• Susan G. Komen for the Cure does not sell, loan or distribute its mailing list or email addresses to any company or individual.
• Komen is unable to secure celebrities for promotional purposes.
• We sometimes find that proposals offered are better suited for a local versus a national program. Susan G. Komen for the Cure has 125 local Affiliates across the United States serving more than 18,000 communities. If the proposal is considered to be more appropriate for review as a local program, it will be referred to the Affiliate nearest you for their consideration. A representative of that Affiliate will review the proposal and then communicate directly with you.
• If your organization is interested in selling your product via the Komen website only (Promise Shop – on line gift store) please contact PromiseShop@Komen.org for further information.

I think they just want to make sure noone is running a scam using their name. It's, unfortunately, not that uncommon these days.

They're a good charity, I see no reason to change.

Boy oh Boy I hope we carry on, my calendars are on the move and are now in the hands of Canadian Customes and I think Dave said they had his for a few days so I hope to have them soon. Its been such a long road for them to get to me I'd hate for them to want us to stop selling the calendars in their name.
