I routinely do a google search every couple of months to see if any copyright material has been stolen. On this occasion photographs turned up on two French websites. They had been taken from google earth by copying and pasting the links onto their web sites. I wrote to google and they said take it up with the people who are using the photos. When I e-mailed one of the web sites and they said it is perfectly legitimate and if you don’t like it take the photo down. The other web site displayed no e-mail address. Instead it had a contact webmaster button which attempted to give me a virus when pressed.
I am not sure if it is legitimate or not. If they had asked I would probably given permission. What I decided to do is change the titles of the photographs (six) to read THIS PHOTO IS STOLEN AND IS BEING USED WITHOUT THE OWNERS CONSENT. That is a polite printable version. Within twenty four hour s an e-mail arrived containing an apology and a whining explanation of how it was an information website rather than a commercial website. This website consisted solely of photographs lifted from google earth. Is that legitimate? Anyway I gave permission and changed the titles to include a link to my website. What else can you do?

No way. There are too many jockers and softies on here. If they could see the person the photographer whose image they were voting on, it would definitely effect the results. |
I don't mind the idea BUT it should happen after voting like the comentators paper bag thing...
I have no idea how hard this would be to set up maybe to hard but if possible have a AUTO Signature where you could add your name in the submit photo page, this would only be added to the photo automatically after the voting is completed and the results are calculated. This is also the time that submitted photo's go public.
Something to think about maybe. |

No, all it takes to copyright an image is to click the shutter.
If you also register the images with the copyright office, it expands your legal options and remedies.
No copyright mark is necessary, however, it does make the "I didn't know it was copyrighted when I stole it" excuse sound even lamer in court than it already is.

I agree that she is showing what she likes, call it flattery maybe? I suspect that would be up to each photographer.

Yeah if she's stealing the images, I don't know how accurate her story is..
oh and.. I think we the photographers should be allowe to mark our pictures, Ie put our names in the corner. Thats all it takes to copyright an image gaurenteed, and makes it alot easy to persue legal action.

Regardless of her intent, she should ask for permission and respect the creator's wishes.
Since she's an author, do you think she'd appreciate me offering her books for free on my website? |

It's more than just photos too. There's a lot of just regular art work in there as well. I saw an image with a neat idea for expert editing in there. |

how good of a print can you get from something that's 500x400 @ 72 dpi? anything above 2x3" is just going to look mediocre.

i agree completely. as a designer, i save everything i like that's not bolted down. this appears just to be a personal album of photos that she enjoys looking at. this isn't beeing profited off of, or plagiarism on some other art site. it's just a collection of "pretty things" |
But Webshots allows and even encourages downloads. The image I first noticed is for sale on DPC prints, which could be impacted. |

This is definitely one of the "big-f'ing-deal" scenarios, for me. Webshots, Flikr, etc... they're just for personal albums. Photos that the person collected that they appreciate.
They're not making money off it, or representing it as their own work. |

| No kidding. She doesn't claim they're hers in this case, but says she found them on the web, but there is NO attempt to credit photographers. |
