I agree that you are damned either way. Either he takes advantage and everyone else will want the same deal, or he badmouths you to them.

Probably the best thing you can do is low res watermarked images. Do the watermark the right way and the images will be usable for a preview, but more hassle to edit out than anyone will want to bother with. At least that way you are not refusing and if anyone else asks, you can just explain this is normal policy and common business practices.

Or, just chalk it up as a loss. Do you really want customers that are constantly going to be trying to screw you over this way?

You could consider a trial of SmugMug pro (14 days). Watermark them on there and limit the size he can see. Set your own prices too.
Just a thought.
There are pros and cons to Smugmug (they keep 15% of profit), but it keeps you somewhat out of the loop which would be nice in situations like this.

I bought a template from Flash Palette. It rocks but the template I have does not allow for print orders. A modestly more expensive one allows for commerce.

register with copyright.gov/ before you sell to him and politely explain that you own copyright to your images and he can pay to purchase rights to print his photos; or he could end up paying up to several thousand dollars in a settlement for copyright infringement :-D...? :-)

personally i'd probably just write a copyright on the photo itself ( and stamp PROOF across his face in a light watermark with photoshop) :-) *IE small on his forehead so its readable but also uneditable/in the respect of making the photo look like crap if he tries to take it out* :-D

This kind of person is most likely going to badmouth you EVEN if he gets what he wants. I agree with the give him his money back and tell him that you cannot in good conscience deal with someone who has told you that they plan to break the law crowd.

When I first owned a business many years ago, a very successful business owner told me this: "90% of your problems will come from 10% of your clients - DUMP the 10%, they cannot hurt you as badly as they, and you, think they can. If you don't dump them, they will continue to hurt you".

I agree. With the slide show he'll see how good it is - and probably show all the friends that he's potentially gonna complain to you about. When he tries printing the screen shots, he'll only look like a cheap-a** loser. :)

I wrote a crummy little program that puts a watermark on the top, middle and bottom of every picture in a folder. It actually creates a subfolder and puts the new image there. It doesn't size them. You can put whatever text you want in the watermark.

You are more than welcome to it. It runs on a PC and the images should already be sized correctly.

Did the 'free sitting fee' deal say anything about getting a CD of photos?

If not, tell him that the 'free sitting fee' deal requires that the client view the proofs and make his selections in your office (or whereever you do business).

Payment for photos ordered is required up front.

ETA: Do you REALLY want to deal with his friends anyway? If they're like him I wouldn't, and if they're not like him, then they probably already know how obnoxious he is. :)

You won't be losing any GOOD business.

If you do decide to give him anything on CD, I'd make him sign something saying that he realizes that it's punishable by law to reproduce the images without the written consent of the artist.

I'd refund any money you've received from him and send him a letter "firing" him as a client.

If you owned a store and someone announced that they were going to steal $100 in merchandise and only buy a pack of gum, wouldn't you throw them out?

yes, and i thought it wa really odd that he was so blunt about it. i talked to his mom(who turns out is paying) and it looks like shes not buying him a cd:)
