I'm not sure what the rules are about linking to another site so if I'm in violation of anything please feel free to remove the thread. I just thought this may be of interest/concern to some considering how often images get stolen. It seems that a self portrait taken when Lara Jade was 14 was stolen and used as a cover for a Porn video, read on....
The fact that this can happen is a real concern but the scary thing is because the image was used in another country there doesn't seem to be much she can do about it.

She's going about it the wrong way. this is a criminal case first. A civil case secondly.

Oh my god. That is DANGEROUS! If some hairy old guy bought that porn and ran into her on the street, what if he recognized her or something??
Gee.. This makes me not want to show my face.. Not that anyone would jerk to it or anything..
You get what I'm saying though, right?
Parents: Use caution in putting your childrens' lovely portraits around..

Folks, just to inject some reality ...
I don't think anyone's going to jail. They didn't put HER in the movie. They put her image on the front cover. Nothing was done illegally with underage kids.
As far as I know, copyright infringement is a civil matter, not criminal.
Yes, the company is sleazy. Yes, she has every right to be mad. Yes, it's sad that it happens.
But none of that makes it a crime with jail time for anyone.

I think they should pay her something for using her image anyways.. They made money with it, she should make money with it too..
But.. Exposing a minor's face in such a manner.. It makes me very angry. |

Yep, several people have pointed her to the Texas AG already. I bet they would LOVE a reason to have a high-profile anti-porn case happen to help them get re-elected. |

Whether or not she is IN the porn doesn't matter. They are still using her likeness to profit from pornography. That's called Child Exploitation and is illegal.
Other avenues she could pursue would be defamation of character and ofcourse the copyright issue.

They still put a 14 year old's face in the porn cover, I think thats still child exploitation.. right?

Has anyone suggested any of these things to her?
I'd contact her and do it.. But I'm on a school computer and the tech guys stalk me like tigers.. Not sure they'd like me looking at something even somewhat related to pornography.. |

Nomatter what the offense is, child exploitation or copyright infringement.. Whatever you call it.. The raw facts are that some guy stole a picture of a minor and used it to sell his product which happened to be pornography.
He did something wrong nomatter how you look at it.. |

Absolutely he did wrong. And absolutely she should be paid compensation. And absolutely, her image never should have been used.
My point is only that there are differences between civil and criminal penalties. And Leroy, I'll admit I don't know the legal details, so maybe you're right. But too many people jump straight from "this seems wrong to me" to "the guy's going to jail."

That may be bad, and it is, but Getty is a whole lot worse - they're stealing from all of us!
Getty Images learned a few years ago that they could buy 4x5 negatives of images from the US National Archives for $5 each. They bought thousands. Now they are selling these same images through their stock agency and claiming copyright on them. The vast majority of the images in the National Archives were taken by government employees and are public domain.
As public domain images, these images belong to us, the U.S. public. Getty, or anyone else, has absolutely no right to claim copyright to these images and sell them.

You know what's sad. Not everyone knows the story behind her uploading her picture to a site and then having someone steal it. That is like us uploading to a challenge and then winning a ribbon, then having someone steal it and saying that it's our fault it was stolen. WTF. ignorant people like that make me sick. Some idiot said that she uploaded it to a website and if she didn't want it stolen she should have put a copyright on it. SHE DID, IT WAS ON HER DRESS... Oh well.
It's wrong what happened to her and I would sue the living crap out of that company and YES she should get paid for it. They used her as marketing. She should get double the amount that someone would normally get, IMO.
