I went out to a local park called Berg Park. Cory knows where this is. It's a park inside the city limits about 3 miles long and 1 mile wide or so. It has all sorts of animals in it from ducks, deer, geese, you name it. I went there today for like 15 minutes because there is a river that runs through it and its really low and you can walk from one side to the other now. I saw some deer crossing the river from a 4 lane bridge. I snuck up on them and found the deer no problem but they already went to the other side and into the trees. I walked along a park trail towards the bridge and I jumped up 2 more deer. Now here is the question. If one of these deer had run into the highway and cause major 15 car pileup would I be responsible? I am thinking no and no more then a runner or jogger or someone with there dog. I wasn't herding or chasing the deer just happened to come up upon them. I could also see if I was actively chasing them like a lunatic I might be responsible. Just curious if I needed to format a card real fast if it ever happened :)

We all know the answer to that one; it would be cory's fault!

I think the responsibility lies with the driver at the front who should have been aware there were deer present in the area (we have road signs showing deer in country areas) - I mean, the deer could have been spooked for any reason, not just necessarily you walking past.

I've seen the guardrail packed full of meat, hair, and other unidentifiable deer bits more than once on Browning Parkway right in that area.

You are in no way responsible, but do try to get some pictures, since everyone's always doing about 60 in that 45 zone the impact should be pretty spectacular.

Now, some advice - I don't know where you're entering in, but if you head to the western most foot bridge and cross over, then take the first right, it'll take you to the back area of the park along the hydroplant ditch. There's a ton of great wildlife back there, and a few unofficial trails. If you turn right at the ditch, and head a couple of hundred yards down the trail, there is an oil-field location there which I spent three days painting camouflage to match the trees and other stuff in that area. Probably completely different now, but it was an awesome camo job ten or fifteen years ago. :)

Another great area is available to you if you cross the bridge, and just cut directly right, off trail - it becomes private land pretty quickly, but that's where most of the deer used to like to bed down years ago.

If you're in the area, I'd also suggest heading over to Browning Ranches - Bob is a superb guy, almost like a grandfather to me, I have little doubt that he'd welcome you and let you have all the pictures you want - not sure what's on the ranch now, but he's always kept a pretty good variety of things - once we even had a zebra that he wanted to raise for cross-breeding with his appaloosas.

Very true, which is why you simply disappear before anyone has an opportunity to even notice you.

Typically the darker areas or legs and head are what gains the stripes, while the lighter areas would probably remain stripe free - although, as with any crossbreed, it's hard to predict exactly what will happen, especially with the complexity of the appaloosa epigenetics.

I can only speak from experience; I've hit two deer (and one moose). Actually I hit deer one and the other hit me. The second was spooked by a hunter who came to the scene of the accident and told us he had just jumped the deer.

In both cases the accident was covered by the comprehensive portion of my insurance as an "act of God". There is was no fault. The accident was not held against me and it did not affect my insurance rate.

An argument could be made that the other drivers were at fault for their own damage because they were not travelling at a safe distance allowing them to avoid the initial accident. If a car stops quickly in front of you in traffic and you fail to stop hitting it from behind it’s your fault not theirs.

Where I live, deer and moose accidents are common and can occur in areas with signage or not. The driver has no more responsibility in areas with signs than areas without signs.

According to Donna -- Department of Natural resourses need to move the deer crossing signs to a safer place.

Gimme a BREAK! I'm paraphrasing to bring the song into the current context (note also "our" for "thy") which is a legitimate artistic leitmotif (or something equally profound). Jejeje
