I think you need to make it very clear that the first invoice was a time limited discount offer, and send another invoice for the full amount. I would send it via registered mail, and also make it clear that should he throw this away you will simply take him to court, win the full amount, and tack on fees for both the council and your time, billed at your normal rate.

I'm not interested in dealing personally with the thief, or making any money from this experience, so I'm taking the lawyer route if it's feasible.

I don't care if I get a penny as a result of this thievery. There are plenty of photographers being ripped off like this, food snatched from the mouths of their families, to use that cliché. Someone needs to do something, and it may as well be you and I. Just because the theft is electronic, the Halton Police and my tax money won't help.

I want M to learn some respect and show some remorse, but judging by his voicemail and lack of any other response, I think he's the type that will only learn at the expense of his bank account. Perhaps an additional, annual charge can be added for past use of my photo. He's had the domain since 2008, but I don't know how long the site has been up. It would be interesting to know what his profit has been during the time he's used my photo, and how much profit might be attributed to it.

If you right-click on my photo when it comes into rotation at www.xxxxxxxxxxxxxxxxxxx.com , and select Properties, you will see that it has "DELETED" in the file name. I think M made an honest, yet failed, attempt to delete the photo, demonstrating two things: 1) his understanding that he should not be using my photo without permission, 2) he is inept . Nevertheless, he hired people who stole it, and used it, possibly for three years. For all he knows, every photo on his site is stolen. Honest or not, I have been wronged and M did no more than thumb his nose at me, the law and polite consideration, then tossed my invoice in the garbage. It is probably his opinion that the person he hired to build his website is liable. I don't know if that's the case.

www.gettyimages.ca has a good price calculator where visually similar photos at small pixel size go for over $2,000 for property/real estate for three years' use on a website banner. If I spent more time digging I might find more for twice the cost.

I would like for you to teach M a lesson for all photographers. As a published photographer yourself, I hope you will take an interest in raising the banner for us all, "We're fed up, and we won't take it any more!" I'm thinking red lettering on a black background would be nice.

If you do go to court, you should know that there's a secret word, that if you say it-- the judge will find in your favor.

Fastforward to the 2 minute and 36 second spot and watch from there.

I noticed he has finally removed my shot from his website, which made me laugh.

Zeroaire status is more like it. I'll probably send another invoice as per Doc's suggestion, then when he ignores that, I'll go through small claims ourt, which costs $100, and so is a gamble. But I've lost more than that at the black jack table in a few minutes.

Canadian Thanksgiving travelling. A couple of weekends of charity work for the local hospital (raised over $90,000). Kids having sleepovers. Halloween festivities.

It's been a busy month outside of work. I'll get around to it. I'm in no hurry. :-)
