They got that one from Panaramio (Google Earth). It's the only place I put that one. Are you implying I don't have a case? :-(


Whoa! I'm pretty sure that posting to Panoramio is tantamount to surrendering copyright. It's GOT to be covered by a Creative Commons license or something...

I checked to see if they were just streaming right from google earth, but they are not... they stole it outright...

and the funny thing is, even though it's still on the site, the name is "home-right-2_DELETED.jpg"

You know what is the most interesting part.. As far as I can see, there is no copyright notice on any page within the site...

Got it, thx. I had some emails back & forth with a tourism person, who sent an email to the 'webmaster' asking for my photo to be removed. That's the guys name in the PM you sent me. That was two weeks ago. Maybe that's why the file name has the word 'delete' in it. Interesting.

I second this - if nothing else they may simply pay because they're concerned enough about your mental health to be scared of you.. :) And, please, video is a must set the camera somewhere though so we can see all the action... LOL

Ah, I missed his phone call at 4:35 yesterday! He said he'd taken the shot down two weeks ago, so he'd just throw my invoice away.

I didn't get the message until after 5:00 and nobody was there when I phoned back. My message was that if I were to break into one of his rentals, he'd either have me arrested or give me an invoice, which is sort of the same thing as his stealing my photo, and I'm giving him a break by just giving him an invoice. And what a nerve you have throwing out my invoice.

It probably sounds pretty bad because I was getting loud trying to hear myself over the train conductor who was screaming out of the speakers at the time.

I know it's never good to leave a message... oh well. :-D

Well keep us updated. If you can, record all the conversations with him..

Just because he changed the file name to deleted doesnt mean the file is deleted hahaha

hire and attorney and sue him for pain and suffering, we can vouch for you.

really though, tell him you will hire a lawyer to subpoena their internet records and any internet business generated during the the time the photo has been active can be tied to your image as assisting and you should be entitled to a percentage of the sales, or they can settle by just paying your fee.

This where people that don't understand copyright get upset. When they learn that simply taking down or ceasing to use an image isn't enough to avoid having to pay for using the image, they tend to lose their minds and get squirrelly. When they finally do consult an attorney and the attorney tells them they can pay the invoice now or pay a lot more after going to court, the smart ones pay. The dumb ones go to court and pay a lot more.

Please find attached invoice for the photo currently being used on your website, www..........com. The domain which is registered to your name.

Payment is due September 26, 2011. If I do not hear from you, and payment is not received by then I will assume you do not intend to pay and I will be referring to a copyright lawyer.
