1. I did. You can see that I have 6 images that are not challenge entries. 3 of those have watermarks. The other 3 are "humour" works and I chose not to watermark them because I was not concerned about them. The point is that HAD THE CHOICE, and was able to make up my own mind on what I want to watermark or not.

2. It, to the best of my knowledge (I am not a lawyer, hence my original question) a "fair use" as well as a derivative work. It was done as a non-profit educational purpose (a godzilla editing challenge is to show what can be done with editing). If I am wrong on that then I apologize and will certainly remove the offending photo. Oh, and if the copyright owner of the original image had watermarked it I would not have used it. ;)

So, knowing full well that you are NOT a lawyer, and not knowing for sure, rather than do the right thing and seek permission from the owner, you just assumed "fair use" and in a thin "educational" guise, used it.

You can make anything sound ugly if you want to do so.

So is there going to be further info disseminated on what the site's planning on doing?

I only looked at the thumbnails in your portfolio and didn't notice your watermarks. I guess I'm getting a little frustrated with the continual carping on this issue when we (the site) are trying to address it in a reasoned and responsible way. The fact that we have had polls (and a variety of user opinions) both shows we care, and has potentially made putting a solution into effect more complicated.

I'm not a lawyer either, but Langdon consulted one in devising/revising the Terms of Use, and I suspect that posting a copyright notice on every page, plus renaming every posted image "Copyrighted_Image_Reuse_Prohibited ..." constitutes taking "reasonable precautions" against infringement.

Your Spongebob picture may well (or may not) constitute "fair use," but I wonder what your reaction would be if you found one of your images similarly modified on someone's Flickr account.

Incidentally I agree - I just used the example to point out that DPC does appear to have the necessary rights to implement a watermarking solution if it chooses to do so.

The survey results are available here. You can click on the individual answers to see how those users answered the other questions in the survey. What the numbers boil down to is that a decent majority of the survey participants would use the feature if it was offered and less than 30% appear to be totally opposed.

It seems the best way forward on this would be to offer Members an option to protect their current, past, and future challenge entries with a default watermark. I worked up an example, shown here. If you click the image, it will toggle between the watermarked and non-watermarked option. I did this to make sure that quality was preserved. The opacity of the watermark may be adjusted prior to release of this feature.

On top of that, on a per-image basis, there will be override options. You will be able to choose the watermark's position (top+right, top+left, bottom+right, bottom+left, center) and color (white or black). Based on usage and interest, we may expand it in the future to allow custom watermarks. Additionally, should your membership expires, your watermarks will not be removed, but new challenge entries will not receive the watermark.

I think this will be mostly beneficial for this site for a few reasons. It will calm those who are worried about image theft, reduce many forum arguments, still give proper credit when links are made like this, and perhaps with watermarking we can get rid of that terrible overlay. :)

Expect this within the next few weeks. And DPL2 shortly thereafter.

i really like this and I'm glad you are moving forward. However I have some issues with the actual watermark, namely the placement. I think putting it in any of the corners is quite silly if someone is indeed trying to protect a photo. The center is thus the only option and this to me is too limiting. I would like to see a midpoint between the corners and the center as an option on all four sides. This way it cannot be cropped out and yet isn't slapping you across the face. Just my opinion.

Me too with IE 6 (yikes we are so behind the times at work!) Worked fine with Safari, Firefox and Chrome.

Haha, oops! It looks like IE6 was doing the right thing by displaying the red X. I put three forward slashes in my link (///). Fixed.

Oh, dear. Langdon, I still cannot see the watermark.

I have clicked twice on the image. Nothing.
I have clicked once on the image. Nothing.

However, if I hold the mouse down (either click method) I can move what appears to be a just plain overlay (without a watermark) around.
It is slightly smaller during the moving process. When I lift the mouse, the overlay snaps back onto the main picture. When I copied the picture to my computer to see if the watermark was active there, it copied easily and completely without a watermark.

FWIW, I use a Dell PC with Vista and Firefox.

Am I the only one on DPC who can't see the watermark?

Did you look in the lower left corner of the sample image? It toggles on and off, at least for me now. It's pretty subtle!

I agree with Beef about placement...if we can adjust that, then this is simply awesome! Thank you very much for addressing this very controversial issue. I am looking forward to this being a reality in the next few weeks so I can get back to fully participating in this great site!
