I have to shoot a couple of events for local council, and the woman who booked me asked me to organise release forms. She wasn't sure if I would need them, and to be honest I'm not sure either. Does anyone in Australia know if I need them for photojournalism? I'll be shooting kids and adults at Xmas events, and the photos will be put on the council website, submitted to the paper, and possibly used for their future publicity. She offered to supply a staff member to gather names and signatures, but as you can imagine it sounds like a nightmare having to make sure the staff member has been informed of who I shot, then waiting for him/her to catch up with me before the next shot, etc. I have to run round catching all the different things that happen in a 1 1/2 hour time frame per event, so won't have time to hang around. Any ideas of the legalities?

When I was working for an organisation running events for local councils, we had to have the release forms available for people, but it was up to them whether they wanted to fill them in or not. So if you have them freely available at a desk or something, I think you are covered.

Yay, there IS life in Australia today! I thought maybe you had all perished in those storms - actually thats not a funny joke, it must have been terrible for you. Hope you're ok.
So you think people can choose whether to sign them and the council is still free to use their faces? It seems strange, but then again when I've been shot for the paper, or my kids, I've never had to sign anything. I'm wondering if most photographers are just dodging the issue, or whether it only applies to using them for profit, ie, selling the images?

I think that in public places, no names, or embarrassing poses - you are ok. They are probably going overboard just to be on the safe side. I'm fairly sure that anybody in a public place is fair game.

Thanks for your answers. I'm still confused - so what DO we need release forms for? I mean, if we go into a children's playground we get swatted away for being paedophiles, we're not allowed to take photos of children at schools without parental permission, and there are release forms around. But if a journalist wants to take photos, he/she can. Does anyone know the actual law here?

Not a legal bod - so take it with a grain of salt - But. Our local council just had a clean up - a photographer taking photos - asked people if they minded - but no release forms. I assume they are going to use them on their web site etc. As regard photos of children ( I don't know if I should be saying this on a public forum) but ! Legally - you could take photos from a school fence. If you are a convicted paedophilia it is illegal for you to take photos. Otherwise the only law they can get you on is " being a public nuisence". Inside the school gates are another matter and often at school concerts etc - it is a copyright issue (the play or music used).It is often what people find acceptable - rather than the law. If you are going to use close ups or clear faces - it might be good form to get a release form - but for group shots etc I wouldn't bother.
