I'm curious as to whether he KNEW and INTENTIONALLY violated the law. What he was doing would be legal if the particular birds he was shooting were not on the endangered species list. I can easily see where someone is not aware. It cost him his boat and his camera(???) and $9k - that seems stiff unless he knowingly did it.

Per the article: In lieu of turning over his boat motor and camera, Neiger has also agreed to pay $9,000 in fines.
So he agreed to plead guilty to one count and pay $9K in fines.

As for the guy knowing and intentionally violating the law... Maybe maybe not. However, he was observed eight times and runs a business/school teaching others, so you would think he'd research what he could do/what is allowed... Just my 2cents.

In some instances "Knowledge and Intent" have no bearing on the matter at hand since some offences are "Strict Liability" offences. In scenarios such at those, the issue of "Mens Rea" is not considered.

Translated into plain English "You did it, you got caught doing it, you are guilty". One might get a reduced fine if your plea of ignorance is heard by a sympathetic judge.

i agree with tangy, the guy's an idiot. he needs to be paying wendy for lessons in the art of patience instead of running with the attitude of sitting around for 10-15 minutes and saying, "screw this, i ain't waiting for them to fly. i'll just ram the bush their in with my boat! that'll get 'em up..."

Anyone else find this super predictable given the fact that only a few years ago many veteran photojournalists were dismissed from their jobs?
